Terms & conditions of the delikatesi platform

1. Introduction

These Terms & Conditions (hereinafter: Terms) govern the access to and use of the platform DELIKATE🍽️SI(www.delikate.si), which is operated by: Andrii Chasovskoi s.p. It is a B2B informational, presentation, and business platform that connects food manufacturers, distributors, and independent sales professionals or Regional Sales Managers (RSM) operating on a freelance basis. By using this website, the user confirms that they have read, understood, and accepted these Terms.

2. Purpose and Functionality of the Platform

The DELIKATE🍽️SI platform provides:

presentation of food manufacturers and their products, including brands produced by Caps Food Systems ES and snEco;
access to product information, certificates, specifications, catalogues, and price lists in PDF format;
the ability to contact the platform operator for business cooperation;
the option for RSMs or freelance sales representatives to register and access business documentation for the purpose of presenting and distributing products in Slovenia, Croatia, Austria, and Hungary.

The platform does not support online sales and does not process online payments.

3. Legal Nature of the Platform

3.1. The platform is intended exclusively for business-to-business (B2B) use and does not constitute a consumer service under EU consumer protection legislation. 3.2. The information published on the platform does not constitute a commercial offer (offerta) and shall not be interpreted as a binding offer in accordance with the Slovenian Obligations Code. 3.3. Any cooperation between manufacturers, distributors, RSMs, or other partners is formalised solely through separate written agreements concluded directly with Andrii Chasovskoi s.p. 3.4. The platform does not act as an intermediary between third parties and does not guarantee the performance, quality, or outcomes of any business relationships established outside the platform.

4. User and RSM Registration

4.1. Registration on the platform is voluntary and intended for business entities seeking access to documents, product information, or direct business communication. 4.2. Registered users may gain access to PDF documents (price lists, certificates, specifications) for internal business use only. 4.3. RSMs or freelance sales representatives operate as independent contractors, meaning:

registration doesnot create an employment relationship with Andrii Chasovskoi s.p.;
each RSM is solely responsible for their own tax obligations and compliance with the laws of the country in which they operate;
RSMs may not present themselves as employees or official representatives of DELIKATE🍽️SI unless formally authorised in writing.

4.4. The platform operator reserves the right to suspend or revoke access if a user violates these Terms.

5. Access to Documents and Allowed Use

5.1. All documents (PDF certificates, specifications, catalogues, and price lists) are the property of the manufacturers or Andrii Chasovskoi s.p. 5.2. It is prohibited to:

copy the documents;
distribute or forward the documents to unauthorised third parties;
publicly publish, upload, or share the documents on external platforms;
use documentation for competing products or activities.

5.3. The user receives a limited, non-transferable license for internal business use only.

6. Intellectual Property

6.1. All content on the platform (texts, images, product descriptions, graphics, PDFs) is protected by copyright and related rights. 6.2. The trademark DELIKATE🍽️SI and all associated visual elements are the intellectual property of Andrii Chasovskoi s.p. 6.3. Any reproduction, modification, distribution, or use of the platform’s content without prior written consent is strictly prohibited.

7. Limitation of Liability

7.1. The platform is informational in nature. The operator does not guarantee the completeness, accuracy, or timeliness of the published information. 7.2. The operator is not liable for:

decisions made by users based on provided information;
direct or indirect business losses;
activities or conduct of RSMs or third-party distributors;
product quality or compliance of goods manufactured by third parties;
any breach of legal obligations by RSMs, manufacturers, or distributors;
technical interruptions, downtime, or data loss;
the content or functionality of external websites linked from the platform.

7.3. The operator may update, change, or remove content at any time without prior notice.

8. Personal Data Protection (GDPR)

8.1 Data Controller

8.4 Legal Basis

The processing is based on:

the user’s explicit consent;
the legitimate interest of the operator (B2B business communication);
preparation of contractual cooperation.

until the user withdraws consent;
for the duration of business cooperation;
in accordance with statutory retention periods.

8.6 User Rights

Users may request:

These Terms are governed exclusively by the laws of the Republic of Slovenia. Any disputes shall be subject to the exclusive jurisdiction of the District Court in Maribor (Okrožno sodišče v Mariboru), unless mandatory legislation provides otherwise.
